You've heard about the Commonwealth’s program to increase participation of small, woman-owned and minority-owned (SWaM) businesses in state procurements. You've also heard that eVA makes it much easier to connect to government buyers. Who can you contact for assistance with these and other business questions? Learn how to connect the dots between the agencies supporting the SWaM program, the assistance programs they offer, and how you can leverage their resources to market your SWaM status. M03 – Hard and Soft Landings: Limitation-of-Liability Clauses and Related Issues John Westrick – Senior Assistant Attorney General, Office of the Attorney General
The law allows buyers and sellers to allocate the risk of a major mishap associated with their contract, but do you sometimes feel unsure of how to structure or negotiate such clauses? This session, presented by a representative from the Office of the Attorney General, will increase your familiarity with limitation-of-liability clauses and other ways contracting parties try to manage overall risk. Learn what to look for and how to reach agreement while protecting the Commonwealth’s interests.
 
M04 – CM At-Risk Procurement Shirley McNutt, VCO, VCCO – Manager, Construction and Facilities Procurement, DGS/DEB
"At-Risk" CM is a delivery method which entails a commitment by the construction manager to deliver the project within a Guaranteed Maximum Price (GMP), in most cases. The construction manager acts as a consultant in the preconstruction services phase but as the equivalent of a general contractor during the construction phase. When a construction manager is bound to a GMP, the most fundamental character of the relationship is changed. Attend this session to learn about CM at-risk and how this alternative might meet your needs. A fun activity awaits!

Local Government Representatives eVA is not just for state agencies! eVA is growing in use by local town and city governments, public authorities, commissions, and school systems across Virginia. This panel session will share locality members’ experiences (the good and bad) in making use of eVA effective for them. A cross panel discussion, as well as an overview of locality use, will offer tips and strategies for employing eVA from a one-person purchasing office to a large decentralized environment.
M08 – Energy Contracting and Executive Order 48 (2007) Charles Barksdale – Utilities and Performance Contracting Manager, Dept. of Mines, Minerals and Energy Robert Parolisi, VCO – Statewide Services Contract Officer, DGS/DPS
Executive Order 48 (2007) directs the Governor’s Secretaries and all executive branch agencies and institutions to reduce energy consumption and costs, and sets forth a process for coordinating energy policy development within the Executive Branch. This session presents a general overview of the EO with specific attention given to the role of procurement in meeting agency goals. Procurement of natural gas, biodiesel, ethanol, and electricity from renewable sources will be discussed. The variety of sources for renewable electricity will be covered including wind, water, solar, biofuels, and green tags. The purpose of this presentation is to prepare agency procurement personnel to assist agencies in meeting these goals.

Auditor of Public Accounts The Auditor of Public Accounts aids citizens, decision makers, buyers and contracting officers of the Commonwealth in the procurement of goods and services. Join this discussion and question and answer session to learn about the APA and what to expect from a procurement audit.
M11 – State Buying through GSA Thomas Corcoran – Business Management Specialist,
US General Services Administration GSA is proud to support our partners in state and local government through the following programs. The Disaster Recovery Purchasing Program (Section 833) allows access to all GSA schedules to support relief efforts in the wake of a Presidentially declared disaster. The Cooperative Purchasing (COOP) permits access to over 5,000 Information Technology vendors offering both products and services. The "1122" program allows purchases from eight separate GSA schedules by state and local governments for the purposes of drug interdiction. Finally, GSA offers support to local governments through the National Wild Fire Program.

M14 – The Price Is Right – Or Is It? Paul R. Higgins, VCO – Manager, Services and Statewide Contracts, DGS/DPS
In a competitive procurement environment, price reasonableness is a fairly mundane exercise, but when you find yourself outside that environment, the determination can sometimes become more nebulous. We will explore the depths of price analysis and parametric estimating and delve into the aspects of cost analysis which provide support to the reasonableness decision of the contract officer. Remember the sage expression – “you get what you pay for” – but the trick is not to pay too much!

This session will discuss requirements for the handling of surplus property. It will give insight on paperwork requirements and different methods of surplusing property that may provide benefit to agencies. Most of the applications and data throughout the Commonwealth today are very agency specific. By migrating the Commonwealth's data, to a common "gold source" with "authoritative sources", the Commonwealth can move beyond agency boundaries to total end-to-end enterprise views of procurement and other statewide processes.
